Immigration Appeal Division

 The Immigration Appeal Division (IAD) hears appeals on immigration-related matters, including sponsorships, removal orders and residency obligations. 

Sponsorship Appeal

 Who can appeal

You can appeal to the IAD if you are a permanent resident or Canadian citizen who made an application to sponsor a family member to immigrate to Canada and the visa application was refused by Immigration, Refugees and Citizenship Canada (IRCC).

 You have 30 days after receiving the refusal letter to appeal to the IAD. 

Removal Order

 Who can appeal

In order to make a removal order appeal, you must have received a removal order and you are:

  • A permanent resident of Canada
  • A foreign national with a permanent resident visa, or
  • A Convention Refugee or Protected Person.

 You have 30 days after receiving the removal order to appeal to the IAD.

 Who can appeal?

You can make a residency obligation appeal if a Canadian overseas visa office found that you did not meet your residency obligation as a permanent resident.

 You have 60 days after the refusal to appeal to the IAD.

 If you’re inadmissible to Canada

Normally, if you’re inadmissible to Canada, you won’t be allowed to enter the country. If you have a valid reason to travel to Canada that is justified in the circumstances, Ingalls may assist you in overcoming inadmissibility. Contact us to speak with our consultant to learn more.

  • be provided with a fair and unbiased assessment of their application
  • be informed of the decision-maker’s concerns and
  • have a meaningful opportunity to provide a response to concerns about their application

Authorization to Return to Canada

A Canadian immigration officer will decide if you can enter Canada when you apply for a visa, an Electronic Travel Authorization (eTA), or when you arrive at a port of entry. If you have been the subject of a removal order from Canada you will probably need an Authorization to Return to Canada (ARC) if you want to return. Whether you need one depends on the type of removal order that was issued.

 When you request your Travel History Report directly from the CBSA it can take up to 30 days to complete. There are many reasons you may require your report, but sometimes requesting it directly is not the best option.
